In a 8/17/18 Legal Ledger post, we updated you on the filing of amicus briefs on two Legal Assistance Fund (LAF) cases. One of those cases was Youngstown City School Dist. Bd. of Edn. v. State of Ohio. OSBA’s LAF was asked to submit a memorandum in support of the district’s request that the Supreme Court of Ohio take up its appeal challenging the constitutionality of Amended Substitute House Bill 70 The bill amended the law governing academic distress commissions.

The 8/13/18 amicus brief was filed on behalf of OSBA, the Buckeye Association of School Administrators, the Ohio Federation of Teachers, the Ohio Association of School Business Officials, and the Lorain City School District Board of Education. In an entry dated 10/24/18, the Supreme Court of Ohio decided to take up the appeal. OSBA attorneys will continue to monitor this case and provide updates. Additionally, you can find more information about the ongoing status of the case on the Supreme Court of Ohio’s online public docket.

OSBA’s LAF supports school districts defending legal challenges with the potential to affect public schools statewide. If you have questions about this case or you’d like to discuss potential LAF assistance for your district, please contact OSBA’s division of legal services. More information about LAF and an application to join or request assistance is available at: https://www.ohioschoolboards.org/legal-assistance-fund.
