Yesterday, the Supreme Court of Ohio issued an opinion in Hicks v. Clermont County Board of Commissioners, in which a public body was sued for violations of the Open Meetings Act (OMA). The Supreme Court determined that, when alleging a violation of the OMA, the plaintiff bears the burden of proving the violation.
Last week, the U.S. District Court concluded that the territory transfer law enacted in the 2019-2020 biennial budget bill violated the Ohio Constitution. As a result, six territory transfers enacted under the law were halted and two territory transfer matters that were to be on the ballot in November are now moot.

In one such LAF case, Buddenberg v. Weisdack, Slip Opinion No. 2020-Ohio-3832, the Ohio School Boards Association, Ohio Transit Risk Pool and County Risk Sharing Authority submitted a joint amicus brief on behalf of defendant-petitioners on December 3, 2018. On July 29, 2020, the Supreme Court of Ohio issued its decision.

Earlier this week, two amicus curiae briefs were filed with the Supreme Court of Ohio on behalf of the Ohio School Boards Association. In both briefs, OSBA was joined by other parties. OSBA had been asked by member school districts to prepare these briefs through its Legal Assistance Fund.
