In this week’s Legal Ledger Sidebar, Sara and Jennie talk about some of the various sources of “the law” and what school boards should do when those different sources of law conflict with one another. Legal conflicts can arise in various contexts, such as when federal and state laws contradict each other, when different jurisdictions assert their authority in differing ways, or when the rules or guidance from agencies clash with statutes or even each other.
Districts with general questions about the current status of “the law” in a particular area are encouraged to reach out to OSBA’s legal division at (855) 672-2529 (855-OSBA-LAW). Districts with questions about specific situations or how to resolve certain conflicts within “the law” should contact their legal counsel.
